The High Court has rejected Ryanair’s application for an injunction against Club Travel. The airline has alleged that the Budget Travel website is ‘screenscrapping’ data from Ryanair’s website in breach of the airline’s policy and sought an injunction pending the outcome of its action against Club Travel.
Mr Justice Brian McGovern described Ryanair’s alleged fear that Budget Travel’s activities would cause unquantifiable damage to the airline’s business and reputation as “somewhat unreal and fanciful”. An injunction was not necessary, he said, because Ryanair, if it succeeded in a full hearing of its claims, had a remedy in damages.
Club Travel has denied Ryanair’s claims and asserts that a consumer enters into a contract with Ryanair for the flight.
